These Terms and Conditions govern your access to and use of GhanAmerica.com, including browsing the website, creating an account, placing orders, purchasing products, using GhanAmerica gift balance or gift cards, submitting reviews, communicating with customer care, and using any related GhanAmerica features, pages, tools, or services.

By accessing GhanAmerica.com, creating an account, placing an order, using any GhanAmerica feature, or making a purchase, you agree to these Terms and Conditions. If you do not agree, do not use GhanAmerica.com or place an order.

1. Definitions

For purposes of these Terms and Conditions:

“GhanAmerica,” “we,” “us,” and “our” mean Andre Roxx Enterprises, LLC, operating GhanAmerica.com.

“Customer,” “you,” and “your” mean any person who accesses GhanAmerica.com, creates an account, places an order, purchases a product, submits content, contacts customer care, or otherwise uses the website.

“Website” means GhanAmerica.com and any related GhanAmerica online pages, checkout pages, account pages, product pages, order pages, return pages, tracking pages, customer care pages, gift-card pages, and other online features.

“Products” means physical products, gift cards, gift balance, and other goods expressly offered for sale through GhanAmerica.com.

“Order” means a purchase request submitted through GhanAmerica.com.

“Gift Balance” means GhanAmerica’s internal stored-value balance, gift card balance, promotional balance, refund balance, account credit, or similar GhanAmerica-issued credit that may be used only as permitted by GhanAmerica.

2. Seller of Record

Unless otherwise clearly stated at checkout, GhanAmerica is the seller of record for purchases made directly through GhanAmerica.com.

GhanAmerica may source, purchase, warehouse, ship, or fulfill products through third-party suppliers, vendors, logistics providers, shipping carriers, or fulfillment partners. These third parties may assist with inventory, shipping, delivery, product data, or fulfillment, but they are not the customer-facing seller of record for purchases made directly through GhanAmerica.com unless expressly stated.

GhanAmerica operates as an online retail store and product aggregator. Unidentified independent third-party sellers do not transact directly with customers through GhanAmerica checkout. Any different seller-of-record arrangement will be clearly disclosed before payment.

3. Website Use and Acceptance

You may use GhanAmerica.com only for lawful purposes and only in accordance with these Terms and Conditions, our Privacy Policy, Return and Refund Policy, Shipping Policy, Payment Policy, Cancellation Policy, and any other policies posted on GhanAmerica.com.

By using the website, you represent that:

You are at least 18 years old;

You have the legal authority to enter into these Terms;

You will provide accurate and truthful information;

You will not use GhanAmerica.com for fraud, abuse, illegal activity, unauthorized resale, or any prohibited purpose;

You will comply with all applicable federal, state, local, and international laws that apply to your purchase, possession, use, shipment, or delivery of any product.

4. Age Requirement

You must be at least 18 years old to create an account, place an order, make a purchase, use gift balance, submit reviews, or otherwise transact on GhanAmerica.com.

Some products may have additional age restrictions, legal restrictions, or purchasing requirements. By purchasing an age-restricted product, you represent that you meet all applicable legal requirements in your location and in the destination where the product will be shipped, delivered, possessed, or used.

GhanAmerica may refuse, cancel, delay, or limit any order if we cannot verify eligibility, age, identity, payment authorization, shipping eligibility, product legality, or compliance with applicable law, payment-processor rules, supplier restrictions, advertising platform policies, or card-network requirements.

5. Accounts and Checkout

Customers may browse, add products to a shopping cart, and place an order through guest checkout without creating or signing in to a GhanAmerica account. Guest customers must provide accurate contact, shipping, billing, and payment information, including a valid email address for order confirmations and shipping updates.

BlackStar Express is an optional paid shipping choice for eligible products. Standard Shipping remains the default method when available.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify GhanAmerica promptly if you believe your account has been accessed without authorization.

You agree to provide accurate, current, and complete account, contact, payment, shipping, and billing information. GhanAmerica may suspend, restrict, or close an account if we believe the account is inaccurate, fraudulent, abusive, inactive, compromised, or being used in violation of these Terms.

GhanAmerica may require email verification, identity verification, payment verification, age verification, fraud review, or other verification before allowing an account action, purchase, refund, replacement, return, gift balance use, or shipment.

6. BlackStar Express

BlackStar Express is GhanAmerica’s optional express-delivery service. It is not a membership or subscription and does not represent that a customer is buying directly from a fulfillment source.

GhanAmerica aggregates product availability and fulfillment capabilities from multiple suppliers, warehouses, carriers, and other fulfillment sources. Products marked Prime or RoxxStar Premium may be labeled BlackStar Express eligible when an available source can support the estimated 4–5-business-day delivery window. Eligibility means the paid option may be selected; it is not the standard shipping method. The option, fee, and estimate are confirmed in checkout before payment.

GhanAmerica may offer clearly described discounts, promotions, or account benefits. A separate promotion is governed by the terms or official rules displayed with that promotion.

7. Products Offered

GhanAmerica sells physical products online. GhanAmerica gift cards and gift balance are governed separately by these Terms.

Physical products are retail goods shipped to customers. Non-physical products and services are not submitted as Shopping offers.

GhanAmerica does not provide professional services, repair services, consulting services, medical services, financial services, legal services, regulated banking services, or other professional advice through the website.

Product availability, descriptions, pricing, shipping options, delivery estimates, images, specifications, categories, and related information may change without notice.

8. Product Information, Images, and Descriptions

GhanAmerica makes reasonable efforts to display product information accurately. However, product images, colors, packaging, labels, dimensions, accessories, manufacturer descriptions, compatibility details, availability, and specifications may vary.

Product images are for reference and may not perfectly match the item received. Packaging, labels, branding, included materials, and manufacturer details may change.

You are responsible for reviewing the product page, product description, size, quantity, compatibility, intended use, warnings, age restrictions, and any manufacturer information before placing an order.

GhanAmerica works to keep product identity, descriptions, images, specifications, prices, variants, availability, and delivery information accurate and consistent. The selected product, price, currency, availability, shipping option, estimated delivery window, and total are confirmed before payment. If GhanAmerica identifies a material data error before order acceptance, GhanAmerica will correct the error or cancel and refund the affected order.

9. Pricing, Taxes, and Fees

Prices are displayed on GhanAmerica.com before purchase and may be viewed in Ghana cedis (GHS) or United States dollars (USD). GHS display amounts use GhanAmerica’s current Kitchen exchange-rate snapshot.

The total order cost, including product price, tax shown in checkout, shipping charges if any, discounts, gift balance use, and other applicable amounts, will be shown during checkout before the order is submitted. GhanAmerica will not add an undisclosed tax, shipping, membership, or handling charge to that order after it is placed.

GhanAmerica may update prices at any time. A price shown on a product page does not guarantee that the same price will remain available later.

If a product is listed with an incorrect price, incorrect discount, incorrect tax calculation, incorrect shipping amount, incorrect availability, or other material error, GhanAmerica may cancel the order, correct the error, request confirmation of the corrected order, or issue a refund if payment was already collected.

Any tax collected by GhanAmerica is displayed in checkout before payment. If checkout displays tax of $0.00, GhanAmerica will not add a later tax charge to that order. Customers remain responsible for duties, customs charges, import fees, or similar government charges not collected by GhanAmerica when applicable.

10. Payment Methods

GhanAmerica currently accepts credit cards, debit cards, and GhanAmerica internal gift balance or gift cards where available.

Payment methods may be added, removed, limited, or changed at any time.

By submitting payment information, you represent that you are authorized to use the payment method and authorize GhanAmerica and its payment processor to charge the total amount shown at checkout.

Payments may be processed by third-party payment processors. GhanAmerica does not intend to store full credit card or debit card numbers on its own servers. Payment information may be handled by the payment processor according to its own security standards, processor rules, and privacy practices.

GhanAmerica may decline, cancel, delay, or refund an order if payment authorization fails, payment is reversed, payment appears fraudulent, the payment method cannot be verified, the product is unavailable, the order violates these Terms, the order violates processor or card-network restrictions, or the order cannot be fulfilled.

11. Gift Cards, Gift Balance, Store Balance, and Account Credit

GhanAmerica may offer internal gift cards, gift balance, store balance, promotional balance, refund balance, or account credit.

GhanAmerica gift balance may be used only for eligible purchases on GhanAmerica.com, subject to GhanAmerica’s rules, product restrictions, account restrictions, fraud controls, and applicable law.

Gift balance is not a bank account, deposit account, credit card, debit card, prepaid card issued by a bank, or cash account. Gift balance does not earn interest.

Gift balance is not redeemable for cash except where required by law.

GhanAmerica may refuse, suspend, restrict, reverse, or cancel gift balance if we believe it was obtained, used, transferred, redeemed, or attempted to be used through fraud, abuse, system error, unauthorized access, violation of these Terms, or illegal activity.

If an order paid with gift balance is refunded, the refunded amount attributable to the gift balance will be returned to the customer’s GhanAmerica gift balance unless otherwise required by law.

12. Order Placement and Order Acceptance

Placing an order does not guarantee acceptance of the order.

After you submit an order, GhanAmerica may send an order confirmation or acknowledgement. An order confirmation means we received your order request; it does not guarantee that the order has been accepted, fulfilled, shipped, or completed.

GhanAmerica may accept, reject, cancel, delay, limit, or modify an order for reasons including but not limited to:

Product unavailability;

Price or product information errors;

Payment failure or suspected fraud;

Incorrect shipping or billing information;

Age-restricted product concerns;

Legal restrictions;

Processor, card-network, supplier, shipping, or advertising platform restrictions;

Quantity limits;

Security concerns;

High-risk order patterns;

Violation of these Terms;

Inability to ship to the address provided;

Any other issue that prevents lawful or proper fulfillment.

If GhanAmerica cancels an order after payment has been collected, GhanAmerica will issue an appropriate refund to the original payment method or applicable gift balance, subject to these Terms and applicable law.

13. Order Cancellations by Customers

Customers may request to cancel an order until the item has shipped.

Once an item has shipped, the order generally cannot be cancelled. After shipment, the customer may request a return according to GhanAmerica’s Return and Refund Policy.

Cancellation requests are not guaranteed. If the order has already entered fulfillment, been processed by a supplier, been packaged, been shipped, or otherwise cannot reasonably be stopped, GhanAmerica may deny the cancellation and require the customer to use the return process after delivery.

14. Shipping and Delivery

GhanAmerica currently ships physical products to deliverable addresses in Ghana. The shipping service, cost, and estimated delivery window are shown before payment.

Standard Shipping is included in the displayed all-in product price and is estimated at up to 14 days after order acceptance. BlackStar Express is an optional paid 4–5-business-day delivery choice for eligible Prime or RoxxStar Premium products and is available only when shown and confirmed in checkout before payment. Carrier, inventory, customs, weather, and destination conditions may affect timing.

GhanAmerica may use multiple suppliers, warehouses, carriers, and fulfillment partners to provide either delivery option. Complete terms are stated in the Shipping Policy, which is incorporated into these Terms.

15. Delivery Problems, Missing Packages, and Carrier Issues

If a package is marked delivered but cannot be located, the customer should promptly contact GhanAmerica customer care.

GhanAmerica may request carrier documentation, delivery photos, address verification, police reports, affidavits, identity verification, or other information to investigate missing, stolen, delayed, or disputed deliveries.

GhanAmerica may provide a refund, replacement, claim assistance, or other resolution at its discretion, based on the carrier record, product type, order history, address, delivery documentation, customer information, and fraud-prevention considerations.

16. Physical Product Catalog and Advertising Eligibility

Product listings submitted to shopping or advertising platforms are limited to eligible physical goods. Digital downloads, services, prohibited products, and listings that do not meet the applicable platform requirements are excluded from those feeds.

GhanAmerica may remove or prevent checkout for an item when its identity, price, availability, condition, shipping eligibility, authenticity, safety, or legal status cannot be verified.

17. Returns and Refunds

GhanAmerica’s Return and Refund Policy is incorporated into these Terms and Conditions.

Most eligible physical products may be returned within 14 days of delivery, subject to the Return and Refund Policy.

Approved returns have free return shipping when the customer follows GhanAmerica’s return instructions and uses the return method provided by GhanAmerica.

To be eligible for a standard return, items generally must be unopened, unused, in original packaging, and returned with all included parts, accessories, and materials.

Opened or used items are generally not eligible for return unless the item arrived damaged, defective, or not working.

Certain items are not eligible for return, including personalized goods, customized items, items that create hygiene or safety concerns, underwear, lingerie, intimate apparel, and other restricted items listed in the Return and Refund Policy.

Refunds are issued to the original payment method. If an order was paid using GhanAmerica gift balance, the applicable refund will be returned to the customer’s GhanAmerica gift balance.

After GhanAmerica receives and verifies the returned item, GhanAmerica will process the refund within 7 to 10 business days. Banks, card issuers, and payment processors may take additional time to post the refund after GhanAmerica issues it.

18. Damaged, Defective, or Incorrect Items

If an item arrives damaged, defective, not working, or materially different from what was ordered, the customer should contact GhanAmerica customer care promptly and provide accurate details.

GhanAmerica may request photos, video, packaging images, serial numbers, product labels, written descriptions, return inspection, or other documentation.

For approved damaged, defective, or incorrect-item claims, GhanAmerica may offer a refund, replacement, return, repair assistance, manufacturer warranty referral, or other resolution at GhanAmerica’s discretion, subject to applicable law.

GhanAmerica may deny a claim if the item was damaged after delivery, altered, misused, installed incorrectly, abused, used contrary to instructions, missing parts due to customer handling, or returned in a condition inconsistent with the customer’s claim.

19. Manufacturer Warranties

Some products may include a manufacturer’s warranty. Manufacturer warranties, if available, are provided by the manufacturer and are subject to the manufacturer’s terms, limitations, requirements, and claim process.

GhanAmerica is a reseller and does not create, expand, or guarantee manufacturer warranties unless expressly stated in writing by GhanAmerica.

After GhanAmerica’s return window expires, customers may need to contact the manufacturer directly for warranty support, repair, replacement, or service.

20. Prohibited and Restricted Products

GhanAmerica does not knowingly offer illegal goods, counterfeit goods, prohibited weapons or ammunition, explosives, tobacco or nicotine products, recreational drugs, prescription-only medicines, explicit adult sexual products, gambling devices, spyware, or other products prohibited by applicable law, payment processors, carriers, or the advertising platform through which an item is promoted.

Automated catalog controls prevent identified prohibited products from appearing in public product listings or checkout. If an automated process incorrectly publishes a prohibited item, GhanAmerica may immediately remove it and cancel any affected transaction.

21. Product Eligibility and Verification

GhanAmerica may withhold, remove, or cancel a product or order when required product identity, authenticity, safety, shipping, pricing, or compliance information cannot be verified.

22. Product Safety and Customer Responsibility

Products should be used only as intended and according to manufacturer instructions, warnings, manuals, labels, and safety information.

You are responsible for determining whether a product is appropriate, compatible, safe, legal, and suitable for your intended use.

GhanAmerica is not responsible for injury, damage, misuse, improper installation, unlawful use, modification, unauthorized repair, failure to follow instructions, or use of a product in a manner not intended by the manufacturer.

Nothing in these Terms limits liability that cannot legally be limited.

23. Promotions, Discounts, Coupons, and Giveaways

GhanAmerica may offer clearly described promotions, coupons, discounts, account benefits, contests, or sweepstakes. Each offer is subject to the eligibility dates, limits, and other terms displayed with that offer.

GhanAmerica does not treat a general reference to future member benefits as a promise that a particular promotion, prize, or discount is active. A contest or sweepstakes is offered only when separate official rules are publicly available.

24. Reviews, Comments, and User Content

Ratings or reviews identified as GhanAmerica customer reviews come from GhanAmerica customers or GhanAmerica review records. Manufacturer, supplier, or other third-party ratings are not represented as GhanAmerica verified-purchase reviews.

GhanAmerica may allow customers to submit reviews, ratings, photos, comments, questions, feedback, messages, suggestions, or other content.

By submitting content to GhanAmerica, you represent that:

You own or have the right to submit the content;

The content is truthful and based on your actual experience;

The content does not infringe any rights of another person or business;

The content does not contain false, misleading, defamatory, obscene, hateful, threatening, illegal, or harmful material;

The content does not include private information of another person without permission;

The content does not contain spam, malware, advertising, or unrelated promotional material.

By submitting content, you grant GhanAmerica a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, display, reproduce, edit, publish, translate, distribute, create derivative works from, and otherwise use the content in connection with GhanAmerica’s website, business, marketing, advertising, social media, customer support, analytics, and product listings.

You understand that GhanAmerica may moderate, edit, reject, remove, or refuse to display user content at its discretion.

25. Intellectual Property

All content on GhanAmerica.com, including logos, names, branding, page design, text, graphics, product presentation, icons, buttons, images, videos, software, databases, code, layout, animations, features, and other materials, is owned by GhanAmerica, licensed to GhanAmerica, or used with permission.

You may not copy, reproduce, scrape, download, distribute, modify, publish, sell, reverse engineer, create derivative works from, or exploit any GhanAmerica content except as permitted by law or expressly authorized in writing by GhanAmerica.

The names GhanAmerica, BlackStar Express, and related logos, branding, graphics, slogans, and designs are protected business assets of GhanAmerica.

Third-party trademarks, brand names, manufacturer names, product names, carrier names, payment processor names, and platform names belong to their respective owners. Reference to a third-party brand does not imply endorsement, sponsorship, affiliation, or partnership unless expressly stated.

26. Copyright Complaints

If you believe content on GhanAmerica.com infringes your copyright or intellectual property rights, contact GhanAmerica at info@ghanamerica.com with enough information for us to review the claim.

Your notice should include:

Your name and contact information;

A description of the copyrighted work or protected material;

The specific GhanAmerica page or content you believe is infringing;

A statement that you have a good-faith belief that the use is unauthorized;

A statement that the information in your notice is accurate;

Your physical or electronic signature.

GhanAmerica may remove or disable access to content when appropriate.

27. Prohibited Website Activity

You may not use GhanAmerica.com to:

Commit fraud or attempt unauthorized transactions;

Use stolen payment information;

Create false accounts;

Misrepresent your identity, age, location, or eligibility;

Interfere with website security or operation;

Attempt to access another customer’s account;

Scrape, crawl, harvest, copy, or extract data without permission;

Use bots, automated tools, or unauthorized scripts;

Reverse engineer or attempt to copy website code or functionality;

Upload malware, harmful code, spam, or abusive content;

Exploit pricing errors, technical errors, or system vulnerabilities;

Circumvent purchase limits, return limits, fraud controls, age checks, shipping restrictions, or product restrictions;

Use GhanAmerica for illegal, harmful, abusive, or unauthorized purposes.

GhanAmerica may suspend or terminate access, cancel orders, refuse refunds, restrict accounts, preserve evidence, contact law enforcement, or take legal action if prohibited activity occurs.

28. Fraud Prevention and Security Review

GhanAmerica may use automated and manual review tools to detect fraud, abuse, identity mismatch, payment risk, suspicious activity, unauthorized access, excessive returns, false claims, chargeback abuse, account manipulation, gift balance misuse, or other high-risk activity.

GhanAmerica may request additional verification before processing an order, return, refund, replacement, gift balance transaction, or account action.

GhanAmerica may cancel, delay, or refuse transactions that present unusual risk or violate these Terms.

29. Chargebacks, Payment Disputes, and Customer Care Requirement

GhanAmerica wants customers to resolve problems through customer care whenever possible.

Before filing a payment dispute, chargeback, bank dispute, card dispute, or similar claim, you agree to contact GhanAmerica customer care at info@ghanamerica.com and allow GhanAmerica a reasonable opportunity to investigate and resolve the issue through available customer service channels, including escalation where appropriate.

This customer-care requirement does not waive any legal rights you may have under applicable law or payment-card rules. However, you agree not to file false, misleading, abusive, duplicate, or bad-faith disputes.

If you file a payment dispute after GhanAmerica has already issued a refund, replacement, credit, or resolution, you agree to cooperate in correcting the duplicate claim.

GhanAmerica may provide order records, shipping records, delivery records, return records, refund records, account records, communications, product information, and other evidence to banks, payment processors, card networks, law enforcement, or other appropriate parties in connection with disputes, chargebacks, fraud reviews, or legal claims.

30. Privacy and Data Protection

Your use of GhanAmerica.com is also governed by GhanAmerica’s Privacy Policy.

GhanAmerica collects customer information for purposes such as account creation, order processing, payment processing, fraud prevention, shipping, returns, customer support, legal compliance, analytics, website operation, and communication.

Payment information may be processed by third-party payment processors. Shipping information may be shared with carriers, suppliers, and fulfillment partners as needed to complete an order.

You agree that GhanAmerica may communicate with you electronically about your account, orders, returns, refunds, shipping, security, policy updates, customer support, and other transactional matters.

31. Electronic Communications

By using GhanAmerica.com, creating an account, placing an order, or contacting GhanAmerica, you consent to receive electronic communications from GhanAmerica.

Electronic communications may include emails, account messages, order confirmations, shipping notices, return instructions, refund notices, support messages, policy updates, security notices, promotional messages where permitted, and other communications.

You agree that electronic notices satisfy any legal requirement that communications be in writing, unless applicable law requires a different method.

32. Third-Party Links and Services

GhanAmerica.com may contain links, references, tools, integrations, or services from third parties, including payment processors, carriers, manufacturers, suppliers, warranty providers, analytics providers, or other platforms.

GhanAmerica is not responsible for third-party websites, policies, content, products, services, security, privacy practices, or actions.

Your use of third-party services may be subject to that third party’s own terms and policies.

33. Website Availability and Technical Issues

GhanAmerica does not guarantee that the website will always be available, uninterrupted, error-free, secure, or compatible with every device or browser.

GhanAmerica may update, modify, suspend, restrict, or discontinue any part of the website at any time.

GhanAmerica is not responsible for losses caused by website outages, technical errors, data delays, product feed errors, third-party service interruptions, internet failures, device problems, browser problems, or events outside GhanAmerica’s reasonable control.

34. No Warranties

GhanAmerica.com and all website features are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, GhanAmerica disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and error-free operation.

Product warranties, if any, are provided by the manufacturer unless GhanAmerica expressly states otherwise in writing.

Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.

35. Limitation of Liability

To the fullest extent permitted by law, GhanAmerica and its owners, officers, employees, contractors, affiliates, vendors, suppliers, processors, logistics partners, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including lost profits, lost revenue, loss of data, business interruption, reputational harm, emotional distress, or loss of opportunity, even if GhanAmerica has been advised of the possibility of such damages.

To the fullest extent permitted by law, GhanAmerica’s total liability for any claim related to an order, product, account, website use, return, refund, or dispute will not exceed the amount you paid to GhanAmerica for the specific product or order giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited.

36. Indemnification

You agree to defend, indemnify, and hold harmless GhanAmerica, Andre Roxx Enterprises, LLC, and their owners, officers, employees, contractors, affiliates, vendors, suppliers, processors, logistics partners, and agents from and against any claims, damages, losses, liabilities, costs, expenses, penalties, or fees, including reasonable attorneys’ fees, arising from:

Your violation of these Terms;

Your misuse of GhanAmerica.com;

Your violation of law;

Your fraud, misrepresentation, or unauthorized activity;

Your misuse of a product;

Your user content;

Your infringement of another person’s rights;

Your chargeback abuse, payment fraud, or false claim;

Your failure to comply with age restrictions, product restrictions, shipping restrictions, or legal requirements.

37. Dispute Resolution and Customer Service Escalation

If a dispute arises, you agree to first contact GhanAmerica customer care at info@ghanamerica.com and allow GhanAmerica a reasonable opportunity to investigate and attempt to resolve the issue.

Customer care may escalate disputes internally when appropriate.

If the dispute cannot be resolved through customer care, the dispute may be handled through the applicable payment processor, bank, card issuer, card network, court, or other lawful process.

These Terms do not require arbitration.

38. Governing Law and Venue
